What legal issues will this false name problem cause?

Mother has been married many times. When my brother was 5 or 6 yr old she got with a man and put his name on my brothers birth cert as father, (it originally said 'father unstated'), which then changed his last name to this man's name. Mom didn't stay with this guy long, never married him. So my brother went back to using the same last name as the rest of us kids. He is married and has a couple kids. Problem is, he didn't remember any of this and mom never spoke up!!!! So his last name is not legally the name he was married with. So his wife and kids last names are not right. Is he still legally married?What legal issues will this false name problem cause?
If he is old enough to get married then he is old enough to legally change his last name.What legal issues will this false name problem cause?

Just changing the fathers name on the birth certificate does not automatically change the childs last name. To have changed his last name would have required a court order.





In any event, it's not a big deal unless he chooses to make it so. He is legally married, and apparently he's had no problem with getting a drivers license, a Social Security card, opening a bank account, etc.

With the new one , he will just have to go to a court house in his town and change the name on all his paper work..
